Scottish Government delays Commission in light of Judicial Review decision

Responding to the outcome of the Judicial Review of the Western Isles school closure call in, Cabinet Secretary for Education and Lifelong Learning, Michael Russell said:

“This judgement applies a wider scope to Ministerial decision making than has existed to date, and indicates that Ministers should look at the merits of school closure, not just the process. We will now consider the judgement in detail, and decide on our next step in due course.

“Given that issues around the operation of this legislation were one of the reasons for the establishment of the Commission on the Delivery of Rural Education, it would be my intention to refer the implications of the judgement to the Commission and as a result this may lead to a short delay in the Commission concluding its work.”
